LVN Fabricated Patient Education During High-Risk Calls
Accurate and thorough documentation in patient records is a cornerstone of quality healthcare, ensuring transparency and continuity of care. However, instances where healthcare professionals engage in falsifying records can have severe consequences for both patients and the integrity of the healthcare system. When nurses find themselves facing allegations related to falsification of patient records, the expertise of a nurse attorney becomes crucial. Nurse attorneys are legal professionals with a deep understanding of healthcare law and its complexities. A nurse attorney advocates for the nurse throughout the legal proceedings, ensuring a fair and thorough investigation.

At the time of the initial incident, he was employed as an LVN at a healthcare facility in San Antonio, Texas, and had been in that position for ten (10) months.
On or about March 18, 2021, to March 23, 2021, while employed as an LVN at a healthcare facility in San Antonio, Texas, and assigned to the Care Management Division, LVN falsely documented that he provided patient education during high-risk phone calls to eight (8) patients in the patients' medical records. LVN's conduct created inaccurate medical records and was likely to injure the patients in that subsequent caregivers would not have accurate information on which to base their future care decisions.
The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13) Texas Occupations Code, and is a violation of 22 TEX ADMIN. CODE §217.11(1)(A),(1)(B)&(1)(D) and 22 TEX. ADMIN. CODE §217.12 (1)(A), (1)(B),(1)(C),(4),(6)(A)&(6)(H).
A case was ultimately filed against him before the Texas Board of Nursing (BON). The said allegation was fatal to the LVN’s capability to perform the essential functions and duties. Sad to say, the nurse attorney who handled his case was not able to properly defend his interests and rights before the Board. The Texas Board of Nursing (BON) found him guilty of the offense alleged in the complaint and decided to place his LVN license under disciplinary action.
